India Cricket Pack

Terms and Conditions:

The Annual India Cricket Pack comprises of 365 days subscription to India Cricket Channel (as defined herein below) which shall air channels offering all International cricket matches in which India is participating. The Annual India Cricket Pack can be subscribed to exclusively by Tata Sky subscribers (hereinafter referred to as “You”).

Definitions

1. “Active account status” means a positive account balance in your Subscriber Account.
2. “Cricket Matches” means all International cricket matches in which India is participating
3. “India Cricket Channel” means the channel on Tata Sky’s DTH platform where the Cricket Matches will be aired as part of the Annual India Cricket Pack

Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract signed between You and Tata Sky. Tata Sky subscribers subscribing to the Annual India Cricket Pack shall be bound by the following terms and conditions:  

1. The Annual India Cricket Pack can be subscribed to at a special price of only Rs 365 per annum
2. You can subscribe to the Annual India Cricket Pack only through the following modes:
   1. By logging on to www.tatasky.com,
   2. By calling the Tata Sky Helpline,
   3. Sending a SMS add incr to 56633
3. You need to subscribe to any one of the popular packs to be able to subscribe to the Annual India Cricket Pack.
4. In order to subscribe to the Annual India Cricket Pack, You must have an Active account status.
5. With the Annual India Cricket Pack, you get to watch all the Cricket Matches provided that the channel broadcasting the said Cricket Matches is available on Tata Sky’s DTH platform.
6. Tata Sky shall not be liable in the event any channel broadcasting the Cricket Matches is withdrawn due to factors beyond its control.
7. The default channel available as part of Annual India Cricket Pack will be Neo Cricket
8. In the event the Cricket Matches are being aired on a channel other than Neo -Cricket, for eg. Star Cricket or Ten Cricket, such channel airing the Cricket Matches will be aired as part of the Annual India Cricket Pack for the duration of the series. Post the Cricket Matches series Neo cricket will be resumed as part of the Annual India Cricket Pack.
9. Please note that in case of any change in the channels being aired as part of the Annual India Cricket Pack, as explained herein above, You will have to appropriately change/select the respective event for PVR recording.
10. In the absence of any Cricket Matches being available, Tata Sky shall air the Neo Cricket as a default channel as part of the Annual India Cricket Pack.
11. If two matches under the same Cricket Matches series are being aired simultaneously where India is playing in one, the match where India is playing will be aired on India Cricket Channel.
12. nt that no Cricket Matches are being played/broadcast then the last Cricket Matches series aired on the India Cricket Channel will continue to be provided until the next Cricket Matches.-
13. The India Cricket Channel will continue to air the entire Cricket Matches series irrespective of India dropping out of the Cricket Matches series at any time. In the highly unlikely event that India is playing in another international cricket match after dropping out of the Cricket Matches series then such international cricket match will be given precedence and shall be shown on the India Cricket Channel instead of the remaining Cricket Matches series.
14. When a subscriber chooses to subscribe to the Annual India Cricket Pack or drop the same after the annual subscription term, all his other services will remain unaffected.
15. To avail of the HD content as provided by the broadcaster, subscribers will have to opt for the HD pack on Tata Sky
16. Subscription of other sports channels shall continue in the subscriber’s account unless otherwise specified by the subscriber
17. In the event of any increase in the price of any of the channels/packs/interactive services during the validity of Your subscription period to the Annual India Cricket Pack, you will be protected from such increase in price for the annual subscription term.
18. The Annual India Cricket Pack Offer is being offered to You at a special discounted price and no refund shall be payable to You under any circumstances.
19. Your subscription to the Annual India Cricket Pack is valid ONLY for a period of 365 days from the date of Your subscription. Post completion of the 365 days period, revised prices may apply as determined at Tata Sky’s sole discretion.
20. On completion of the term of the Annual India Cricket Pack; You agree that You will be automatically migrated to a monthly version where you will be able to continue view the Cricket Matches being played at that point of time, on the Tata Sky platform, but on a daily charge basis; this requires You to have an Active account status at all times for uninterrupted viewing. Lack of Active account status will lead to deactivation of Your Tata Sky service. Should You want to avail of the convenience of the Annual India Cricket Pack for another term of 365 days, You will need to once again subscribe to the same as per the modes provided in pt. 2 herein above, provided that the same is available at that point of time.
21. Subscription to Annual India Cricket Pack does not authorise You to automatically receive any additional services that Tata Sky offers including services like additional Showcase Events or channels like the Topper channel which are not a part of the Annual India Cricket Pack. Subscription to any additional services shall be at an additional cost.
22. Tata Sky reserves the right at anytime, to discontinue any channels contained in the Annual India Cricket Pack.
23. Tata Sky reserves the right at any time, without prior notice, to add or vary all or any of these terms and conditions or to replace or withdraw the Annual India Cricket Pack completely. However, such a change will be prospective and not retrospective in nature to ensure that the Tata Sky subscribers who have already subscribed to the Annual India Cricket Pack are not inconvenienced in any manner.
24. You consent to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any losses, damages, claims, actions, or any liability of any kind resulting from or arising from subscribing to the Annual India Cricket Pack.
25. You acknowledge and agree that all disputes in relation to the Annual India Cricket Pack or these Terms and Conditions shall be subject to the exclusive jurisdiction of Delhi courts.
26. These terms and conditions are in addition to the Terms & Conditions of the Tata Sky Subscription Contract and if there are any inconsistencies between the two, these terms and conditions shall govern for the limited purpose as specified.  These terms and conditions are limited as specified and shall not constitute a modification or waiver of any other provision of the Tata Sky Subscription Contract.
