Tata Sky Zeetos Rewards Programme

Terms & Conditions:

Tata Sky Zeetos Rewards Programme ("Programme") is a loyalty programme offered on the Tata Sky DTH platform.

Tata Sky subscribers (“You”) can participate in the Programme by redeeming Zeetos for exciting Toys/Merchandize.

 You can participate in the Programme either: (i) through the Zeetos Rewards Program section on the Tata Sky interactive platform services section or (ii) through the Actve Wizkids interactive platform services section; on the Tata Sky DTH platform. 

Tata Sky subscribers participating in the Programme shall be bound by the following terms and conditions:

Definitions

1. Zeetos: are the loyalty points that the ZRPMs accumulate each time the ZRPMs participate in contests/quizzes/stories/ games and submit their correct answers/scores on the Tata Sky interactive platform services section.
2. Zeetos Rewards Programme Member (ZRPM): is a Tata Sky subscriber who has subscribed to the Fun Learning Pack, or the Super Value Kids Special Pack or the Mega Pack. Membership to the Zeetos Reward Programme is automatic and participation in the Programme is voluntary
3. Toys/Merchandise Store:  is the listing of the Toys/Merchandize on the Toys/Merchandise Store section on Zeetos Rewards Program section on the Tata Sky interactive platform services section
4. Toys/Merchandise: are the products (listed under the Toy/Merchandise Store section of the Programme) that a ZRPM can redeem his Zeetos for .
5.  Active account status: means a positive account balance in your Subscriber Account.
6. Valid entry: means a code sent via sms by You in the correct prescribed format to 56633.

Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract signed between You and Tata Sky.

Programme Period

Programme shall start on 5 July 2010 and remain valid till withdrawn.

Eligibility

1. The Programme is open ONLY to ZRPMs during the validity of the subscription period of their Fun Learning Pack, Super Value Kids Special Pack or the Mega Pack. Tata Sky subscribers who are subscribed on any other package are not eligible to participate in the Programme
2. The following persons cannot participate in this Programme:
1. Employees and relatives of Tata Sky
2. Tata Sky business associates including its dealers and advertising agencies and
3. Anyone else who may be involved with the Programme.
3. Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate. Only a  submission of the system generated game score/correct answer to the contest/quiz/story questions on the Tata Sky interactive platform services section, will result in Your accumulating Zeetos on the My Zeetos points section on the Zeetos Reward Program section on the Tata Sky interactive platform services section. 
4. Only a Valid entry will result in redemption of Zeetos for the Toys/Merchandise which has been selected on the Zeetos Rewards Program section on the Tata Sky interactive platform services section
5. ZRPM must (i) be a resident of India (ii) be above 18 years of age (iii) have a valid PAN card and (iv) have a Subscriber Account with an Active account status to qualify and participate in the Programme.
6. A Programme membership is valid  only during the validity of the subscription period of the Fun Learning Pack, Super Value Kids Special Pack or the Mega Pack of the ZRPM.
7. The Zeetos are non-transferable except as specified in these terms and conditions.
8. In case the ZRPM chooses to drop or fails to renew his subscription to the Fun Learning Pack, Super Value Kids Special Pack or the Mega Pack or if he allows his Subscriber Account to go into negative status resulting in his Subscriber Account being deactivated, then the ZRPM shall be deemed to have forfeited all the Zeetos accumulated by him till the date of the drop/deactivation.

Toys/Merchandise – Redemption of Zeetos

1. The list of Toys/Merchandise that can be redeemed will be listed on the Zeetos Rewards Program section on the Tata Sky interactive platform services section
2. The Toys/Merchandise can be availed only against redemption of Zeetos. For redemption of Zeetos an item is to be selected on Zeetos Rewards Program section on the Tata Sky interactive platform services section. On selecting the item an item code will be presented. This item code will need to be sent as a Valid entry. Zeetos are not redeemable for cash or any other offer. 
3. The delivery of the Toys/Merchandise availed of by the ZRPM by redeeming his Zeetos is subject to availability. In case of non-availability, Tata Sky shall contact the ZRPM with details of procedure to be followed for availing of any substitute Toys/Merchandize.
4. The ZRPM shall be contacted via phone at the phone number mentioned in the Subscription Contract and shall also receive a congratulations letter with an acknowledgement form which the ZRPM must complete and courier or scan and email or fax to the address mentioned in the letter alongwith a photo copy of the  PAN card of the ZRPM. Upon receipt, verification and processing of the documents received from ZRPM, the Toys/Merchandize availed of shall be delivered to the ZRPM. ZRPMs must allow 60 days for delivery after documents sent by them to Tata Sky have been verified to the satisfaction of Tata Sky
5. Non-submission of necessary documents shall lead to the no. of Zeetos for which redemption request has been sent being forfeited. 
6. If Tata Sky or a Tata Sky representative does not contact the ZRPM who has participated in the Programme within 30 days from the date the sms for redemption of Zeetos was made, the ZRPM can contact Tata Sky on the Tata Sky helpline.
7. By participating in this Programme, You agree that you shall not hold Tata Sky liable for any defect or deficiency in any Toys/Merchandise or for any damage caused to the Toys/Merchandise during delivery or for delayed delivery. In case of any complaints pertaining to the Toys/Merchandize, You can contact the Tata Sky helpline. 

Accrual of Zeetos:

1. Zeetos shall be accrued  when the ZRPMs play games/participate in the contests/quizzes/stories available on Actve Wizkids and -submit their system generated game score/correct answer to the contest/quiz/ story questions on the Tata Sky interactive platform services section
2. For more details on how ZRPM can accumulate the Zeetos, ZRPM must refer to the Zeetos Rewards Program section on the Tata Sky interactive platform services section.

Zeetos calculation:

1. ZRPMs shall submit their game scores/correct answers to contest/quiz/story questions - in order to accumulate Zeetos.
2. Upon submission of the score, the Zeetos as applicable shall be shall be credited into the Zeetos Rewards Program section on the Tata Sky interactive platform services section.
3. You will need to refer the My Zeetos section to know your current/available Zeetos balance.
4. The Zeetos can be earned on both Your Primary Digicomp as well as Your MultiTV connection. However, the points earned on different digicomps will not be considered cumulative on redemption.
5. If Your Digicomp would need to be replaced or repaired, You acknowledge and agree that on account of system and technology constraints, your Zeetos balance shall automatically become Nil and You shall be deemed to have forfeited any Zeetos balance in your ZRPM Subscriber account.  You further agree that you shall not hold Tata Sky liable in such an event.

General

1. You may send as many redemption requests as you wish.
2. You need to have the requisite no. of Zeetos available for redeeming the Toys/Merchandise
3. You must sms your redemption requests to 56633.
4. SMS rates will be applicable as per the tariff of Your mobile service provider.
5. The payment of the product/Toy/Merchandise shall be subject to deduction of applicable withholding taxes as per Indian Income Tax Laws
6. The Tata Sky subscriber will be responsible for any other relevant taxes arising from the receipt of the Toys/Merchandize. You agree to indemnify Tata Sky against any claims incurred by Tata Sky on account of failure on your part to discharge your tax liabilities with respect to the Toys/Merchandise. Any ZRPM who manipulates the Programme in any manner whatsoever shall be liable for disqualification, and forfeiture of the Zeetos accumulated by such ZRPM, at the sole discretion of Tata Sky.
7. Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this Programme or to withdraw it completely.
8. Tata Sky will have the right to use the image of the ZRPMs in any promotional material. By entering the Programme, You agree that You shall participate in any promotional activity(ies) and/or have Your name and likeness featured in any promotional material as Tata Sky may require.
9. Tata Sky will not be liable for any loss, damage or cancellation of this Programme caused by force majeure events beyond its reasonable control including war, natural calamities, floods, failure of telecommunication network, etc.
10. You consent to comply with these  terms and conditions and waive any right to claim ambiguity in these terms and conditions and release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from participation in the Programme including but not limited to any misuse of the Toys/Merchandize.
11. You acknowledge and agree that all disputes in relation to the Programme shall be subject to exclusive jurisdiction of Delhi courts. 
12. Tata Sky is not responsible for printing or typographical errors in any Programme related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error.
13. The Programme is void where prohibited or restricted by law, and is subject to all applicable mandatory national, state and local laws.
