Terms & Conditions - Purchase over Tata Sky Helpline

All Master, Visa and American Express Credit Cards are accepted for making purchases on the Tata Sky helpline. Diners cards and debit cards are not accepted over the Tata Sky helpline.

All credit card transactions over the helpline are carried out through a secured payment gateway.

The cardholder must punch in the credit card details on the secured IVR system with the help of the phone pad.

At no point must the cardholder disclose his/her credit card number, date of expiry or the CVV number over the call to anyone.
A Cardholder can purchase up to 4 Tata Sky digicomp on a single credit card transaction. The total value of the transaction cannot exceed Rs 6,396 (inclusive of all taxes).

Terms & Conditions – Purchase from Tata Sky website

All Master, Visa, Diners and American Express Credit Cards and Debit Cards are accepted for transactions on the payment gateway available through the Tata Sky website. Cardholders can also transact using the net banking option.

Cardholders also have the option to buy annual subscription along with the digicomp.

Cardholders making purchase online will only receive their digicomp and the amount towards annual pack subscription charges (if any annual pack subscribed to) will be directly credited to their Tata Sky Subscriber Account.

Terms & Conditions - General
Tata Sky does not engage in direct retail activities. Payment gateway on the Tata Sky website is being provided by Billdesk (India ideas.com) using the Citibank payment gateway and on the Tata Sky helpline is being provided by Atom Technologies Limited using the ICICI Bank and HDFC bank payment gateway. Invoicing, sale and delivery of the Tata Sky digicomp is being done by Tata Sky authorized distributor and annual pack subscription charges are being collected by Tata Sky.

Delivery shall be made within 5-7 working days. Tata Sky is not liable for any delayed deliveries. All purchases made over a weekend will be dispatched on Monday and will follow the delivery norms as stated above.

Cardholder must verify the contents of the package before accepting delivery. After verification, the Cardholder must sign the way bill confirming acceptance of the package.

Cancellation and refund of transaction(s) will be resolved on a case to case basis. Cardholder must allow for 10 working days in case of a refund. This is required for delivery/non delivery verifications.

On activation of the Tata Sky service, standard terms of the subscription contract will apply.

The success and failure of a card transaction is at the sole discretion of the card issuing bank. Tata Sky assumes no responsibility for any dispute arising there from.

EMI facility is provided by the card issuing bank and Tata Sky has no control or responsibility for the same. For queries on EMI, the Cardholder must consult with the credit card issuing bank. Tata Sky Ltd. takes no responsibility for refusal of EMI by the credit card issuing bank or any dispute regarding the same.

Tata Sky shall not be responsible for any fraudulent or disputed transactions. In case of a dispute regarding any card/net banking transactions made by cardholder through the Tata Sky helpline/website, the same must be resolved by cardholder directly with Your Bank/Credit card issuer. You agree to not make Tata Sky a party to any such dispute. Tata Sky shall not be liable to You/ cardholder for any consequence arising out of any fraudulent or disputed transactions.

Tata Sky reserves the right at anytime, without prior notice, to add or vary all or any of these terms and conditions or to replace, wholly or in part this purchase facility or to withdraw it completely.

By making a purchase over the Tata Sky helpline or website, You hereby agree to comply with these terms and conditions and waive any right to claim ambiguity in these terms and conditions. You agree to release, indemnify and hold harmless Tata Sky and its respective affiliates, advertising and promotion agencies, and all of its respective agents, representatives, officers, directors, shareholders and employees from and against any injuries, losses, damages, claims, actions, or any liability of any kind resulting from or arising from your or any third party’s use (or misuse) of the purchase facility available over the Tata Sky helpline/website.

You acknowledge and agree that all disputes in relation to purchase over the Tata Sky helpline or website shall be subject to Delhi jurisdiction.

These terms and conditions are in addition to the Terms & Conditions of the Subscription Contract and if there are any inconsistencies between the two, these terms and conditions shall govern for the limited purpose as specified herein. These terms and conditions shall not constitute a modification or waiver of any other provision of the Subscription Contract. Terms used herein but not defined shall have the same meaning as assigned to them in the Subscription Contract.

The Offer - Now get a Tata Sky+ HD box with interest free EMI offer. Just make a one-time swipe of Rs 6280 through your credit card but pay only a monthly instalment of Rs 1047 (rounded to last decimal) for 6 consecutive months. This includes the cost of set top box, installation, first month free MultiTV subscription and first month free HD Gold pack

Offer Period – Starts from 2 August, 2011.  Subscribers, availing the offer, will be notified if there’s a discontinuation of the offer 5 days in advance of its discontinuation.

Definition
Existing subscriber –  those who have activated their Tata Sky connection before 2 August, 2012
New Customer –  those who have bought and activated their Tata Sky connection after 2nd August, 2012
Participant –  An Existing Subscriber or New Customer who has bought the Tata Sky+ HD box based on this offer.
EMI – Equated monthly installment

Terms & Conditions means and includes these terms and conditions, and the terms and conditions of the subscription contract that the customer signs with Tata Sky.

Offer Terms

To avail this offer the ‘Participant’ must be an existing or a new customer – as defined herein above of Tata Sky . The Participant  must be a mojor, as defined under Indian Law, residing in India and availing the offer for the connection to be installed in India.

A new customer can also avail the benefit of EMI payment facility, however the total amount to be paid will vary in that case
The ‘Participant’ must hold a credit card of CITIBANK or HDFC Bank only. No other credit card payment will be entertained by Tata Sky during the offer period.

The credit card must be valid for more than 6 months at the time of purchase

The ‘Participant’ can avail this offer from the Tata Sky helpline only. For this it will be necessary to contact our helpline numbers at 0172 6600 6633 (North), 020 66006633 (West), 040 6600 6633 (East & South) &0361 6000 6633 (North East) or SMS plushd to 56633. Cost of the calls made by the participant shall be borne by him. Please check the same from your telecom service provider.

The ‘participant’ needs to make a one-time swipe of the total cost applicable, using his credit card. And can pay back the same amount in 6 EMIs in 6 consecutive months. An existing subscriber will only need to swipe Rs 6280, but can only pay Rs 1047 for 6 months to the bank.
Rs 6280 will include the cost of set top box, installation, first month free MultiTV subscription and first month free HD Gold pack

The bank will send monthly credit card statements of Rs 1047 (rounded to last decimal) for the 6 consecutive months to the customer. The customer needs to pay these EMIs following his usual mode of payment. Tata Sky will not be involved in the billing or any other  issues the Participant may have with his Bank.

This offer is not transferable. This offer cannot be used in conjunction with any alternative offer or promotion.

Tata Sky reserves the right, at any time, to verify eligibility requirements, in any manner deemed appropriate by it. It also reserves the rights to call for any documentary proof from the Participant should it consider necessary.

Participants acknowledge and agree that all disputes in relation to the offer, including but not limited to, eligibility, cheating, advancement, and other issues related to the offer shall be determined in the sole and absolute discretion of Tata Sky, and that such a decision by Tata Sky shall be final and binding.

Participants represent, warrant and undertake (a) to comply with these Rules, and (b) that they release and hold harmless Tata Sky, its respective subsidiaries, affiliates, advertising and promotion agencies, and all of their respective officers, directors, employees, representatives and agents from any and all liability, loss or damage of any kind. Tata Sky is not responsible for printing or typographical errors in any  draw related materials; or for transactions that are lost, misdirected, fail to enter into the processing system, or are processed, reported, or transmitted late or incorrectly or are lost for any reason including computer, telephone, paper transfer, mail system, human or other error; or for electronic, computer, or telephonic malfunction or error, including inability to access any web site associated with this offer, or process any transaction thereon. The Terms and Conditions contained herein, including any rules made hereunder are in addition to the terms & conditions of the subscription contract that the participants sign at the time of purchase of the connection.

Tata Sky in their absolute discretion reserves the right at any time, without giving notice, to add, alter, modify, change or vary all or any of these terms and conditions, wholly or in part. Tata Sky reserve the right to extend, cancel, discontinue, prematurely withdraw, change, alter or modify this offer or any part thereof at their sole discretion during or after the offer period without assigning any reason or prior notice to the participants for reasons including but not limited to business exigencies and/or changes by regulatory authority and/or statutory changes.



Rental offer

a) SD – Advance Rental for 12 months = (12* 216.58) = Rs 2599 Monthly Rental - Rs 216.58
b) HD – Advance Rental for 12 months = (12*341.58) = Rs 4099 Monthly Rental - Rs 341.58
c) HD PVR – Advance Rental for 12 months = (12* 700.00) = Rs 8400. Monthly Rental - Rs 700

Note: The above includes Rs. 133.33, Rs. 133.33 and Rs. 366.75, per month, each, towards SD, HD and HD PVR processing fees, respectively. All other fees and charges, extra.

Terms & Conditions of Rental offer:
  1. The above offer is available only on our website at www.tatasky.com
  2. Company will provide services during Rental scheme period on STB’s as per Company policy at authorized service centers.
  3. Under this offer, STB’s will be made available by the Company to any customer subject to payment of said advance rentals for 12 months. There would be a minimum processing time of 2 to 3 weeks for STB’s to be supplied under this scheme, from the date of placing the order.
  4. This Offer is available after due verification of the customer and at the discretion of Company & decision of Company will be final.
  5. Digicard remains the property of Company.
  6. No transfer and / or shifting allowed without prior permission of Tata Sky during rental scheme period. The Company retains the right to discontinue the scheme to any customer, who has availed the scheme but has deliberately transferred / shifted without the permission of Tata Sky Ltd.
  7. Any transfer / re-location done by company will be on chargeable basis as per company policy.

    2. No refund shall be applicable in the event transfer and / or shifting is undertaken without prior permission of the Company during rental scheme period as stated in clause 6 herein above.
    3. Refund will be applicable only after the subscriber returns both the STB and the digicard to the Company and the STB and Digicard are both found to be  in good, normal working conditions without any damage.
    4. The applicable amount shall thereafter be refunded by way of a crossed cheque and shall be sent at the subscriber’s address available in the Company records.
  9. The repair/replacement of defective STB’s during the payment period in the above plan will be offered without any charge to the customer subject to clause 6 above
  10. All other charges are as per company policy and are extra and include, but are not restricted to, subscription charges, activation charges, installation charges, etc
  11. For the purpose of this scheme, references to STB’s include references to SD, HD and HD PVR whether individually or jointly
